1-29 During a Traffic stop at Front Street and Oakwood Drive for multiple moving violations, the officer spoke with the driver and passenger and detected the strong odor of alcohol. Police also observed open alcohol containers and noticed signs of impairment in the driver. After asking if he had any firearms the driver denied it. He was asked to exit the vehicle to perform field sobriety tests which confirmed his impairment, leading to his arrest. A search of the vehicle uncovered a loaded CANiK handgun, prescription pills not in proper containers, Adderall in a plastic bag, and more open alcohol containers. The passenger couldn’t provide a prescription for the pills on scene, so she was also arrested. The driver admitted the firearm was his and later refused a blood/urine test. The occupants were asked to exit the vehicle and they both consented to a search of their persons, but nothing was found. The driver also consented to a search of the vehicle, where a blue container with a folded paper inside containing white powder residue was found. No other illegal items were located. Both occupants denied possession of the paraphernalia, and while the driver showed signs of recent drug use, there was no evidence of impairment. Police could not determine who owned the paraphernalia. The driver was cited for driving under suspension, and the passenger was warned for improper handling of the firearm. A valid driver arrived to take possession of the vehicle, and paraphernalia was seized.
